This Agreement (“Agreement”) supplements the our affiliate Terms and Conditions and governs the relationship between you (a “Dutch Affiliate”, “you” or “your”) and SATOS B.V. (“Bybit”, “we”, “us” or “our”). If you do not agree to any terms or conditions of this Agreement, you must immediately cease using our affiliate Platform. Unless otherwise defined in this Agreement, all capitalized terms used in this Agreement shall have the meaning provided in our Service Agreement. The additional terms are as follows:

 

 

Restrictions

1. You shall express clearly that the custody services for deposits by Dutch customers are provided by SATOS B.V. a registered crypto provider in the Netherlands.

 

2. You shall when promoting any fiat to crypto campaigns, express clearly that such services, if accessible on Bybit, are provided by SATOS B.V. a registered crypto provider in the Netherlands.

 

3. You shall not promote any futures, derivatives and margin products.

 

4. When creating content, (i.e., natural persons not acting in the course of a business or profession) you shall observe the following restrictions set out in the Unfair Commercial Practices Act (Wet oneerlijke handelspraktijken, Wohp) which provide that:

a. a consumer cannot be denied essential information. Essential information includes the general characteristics, limiting conditions and fiscal treatment of a product;

b. information cannot be hidden or given in an unclear, incomprehensible and ambiguous way;

c. information may not be provided too late;

d. information must always be correct, clear and not misleading;

e. unfair commercial practices (misleading and aggressive) are banned, for instance:

 i. it is not permitted to offer ‘free’ products for which customers ultimately have to pay or quoting prices that do not include all additional charges or costs;

 ii. returns are presented as fixed or guaranteed where they are not actually fixed or guaranteed;

 iii. risks are downplayed (as “controlled” or “minimal” risk);

 iv. in case of a high risk investment, a product is presented as suitable for risk-averse consumers.

 

You understand and accept that failing to adhere to these requirements or if we discover content in breach of these conditions, can result in the termination of your affiliate account and/or the withholding / forefiture of any commissions without further notice to you.
